Image Terms

Welcome to our Squarespace + Getty Images (“Getty”) image terms of service (“Image Terms”).

These Image Terms, along with our Terms of Service and Acceptable Use Policy, cover your licensing of any Getty images via the Services (“Licensed Images”). Any capitalized terms not defined in these Image Terms have the meanings set forth in our Terms of Service.

Where and how can I use Licensed Images?

You are allowed to use Licensed Images in connection with the Squarespace site for which you license them. However, purchasing a Licensed Image under these Image Terms does not convey any ownership rights in the underlying Licensed Images, and your usage rights are limited to only what is described here. If you would like to purchase additional licensing rights for Licensed Images (like offline or advertising use), you can purchase such rights directly from Getty via a link provided in the Services.

Where and how can I use watermarked (i.e., not licensed) images?

Watermarked images are provided for private use only, so that you can get a feel for how an image would look on one of your pages. You cannot otherwise use any watermarked images. Notably, that means you cannot display them on public sites, or otherwise share them with others.

For how long can I use Licensed Images?

You can use Licensed Images for the lifecycle of the site for which you license them. So, if you maintain your site for 10 years, you can use the Licensed Images in connection with your site for 10 years.

Can I use the same Licensed Image more than once on the same site?

Yes. You can use the same Licensed Image multiple times in connection with the same site (e.g., on more than one page on your site, more than once on the same page of your site or within related marketing materials created using the Services such as email campaigns).

Can I use the same Licensed Image on different sites?

No. Licensed Images are site-specific, so you would need to purchase a new license to use an image in connection with another site. For example, if you wanted to use the Licensed Image in connection with three different Squarespace sites, you would need to purchase three licenses (one license for each site).

What is your refund policy for Licensed Images?

We do not provide refunds on purchases of Licensed Images.

If I leave Squarespace and export my contents, can I take Licensed Images with me?

Yes. Even if you stop using the Services, you can take Licensed Images with you and you’re free to use them on another site hosted elsewhere, provided that you’re only using the Licensed Images on a single site and in the same manner as they were used on the original Squarespace site.

I currently have a version 7 Squarespace site but I want to re-build my site using version 7.1. Can I re-use a Licensed Image I bought for my original version 7 site in the new updated version 7.1 site I want to use Squarespace to create?

Yes. This would be OK, so long as you’re only using the Licensed Image in connection with one Squarespace site at a time. So before you publish your version 7.1 site, you will need to un-publish your version 7.0 site. If you wish to publish both sites at the same time, that would be two different Squarespace sites and you would need to purchase two licenses. More details on moving from version 7.0 to version 7.1 in this support guide.

Anything else?

Yes, a few more things.

First, if you use Licensed Images in an editorial context (such as opinion pieces about newsworthy or public interest events), you must include the following credit line (as applicable to your use):

[Photographers Name]/[Collection Name]/[Getty Images or iStock].

Usage in an editorial context means use relating to events that are newsworthy or of public interest. Editorial usage does not include any advertorial sections (e.g., sections for which you get paid by a sponsor or advertiser) or other commercial uses.

Second, you can’t use Licensed Images: (a) on a standalone basis with no other content; (b) in electronic templates for the creation of electronic or printed products; (c) in non-digital form or in digital retail products, such as e-cards, calendars, fine art prints, posters or screensavers; (d) for the purpose of enabling file-sharing of the image file; (e) in logos, trademarks, service marks or other branding or identifiers; or (f) in a way that falsely represents you as the original creator of a Licensed Image.

Third, you may not sell, modify, re-use or re-sell Licensed Images and you may not remove metadata from, reverse engineer, decompile, disassemble, download, republish, retransmit, reproduce or make any other use of the images made available through the Getty Images integration except as expressly permitted under the Agreement or these Image Terms.

Finally, if you use a Licensed Image which features a person in a way that a reasonable person would find offensive, unflattering or controversial, you will include a statement that: (i) the Licensed Image is being used “for illustrative purposes only”; and (ii) the person in the Licensed Image is a model.
